1. Acceptance of Terms

By accessing or using FolioBrief ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

FolioBrief is a SaaS platform that provides AI-generated portfolio analysis and market briefings delivered via email. The Service uses artificial intelligence to analyze user-provided portfolio data and publicly available market information.

FolioBrief provides informational content only and does not constitute investment advice, financial advice, trading advice, or any other sort of advice. You should not treat any of the content as such. FolioBrief does not recommend that any securities, transactions, or investment strategies are suitable for any specific person. All trading and investment decisions should be made based on your own analysis and judgment. Past performance is not indicative of future results.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during registration.

5. Subscription and Billing

  • Free accounts have limited features as described on our pricing page.
  • Paid subscriptions are billed monthly through Stripe. You authorize us to charge your payment method on a recurring basis.
  • You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period.
  • Refunds are handled on a case-by-case basis. Contact us within 14 days of a charge for refund requests.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to reverse engineer, decompile, or extract the AI models or algorithms
  • Share account access with unauthorized third parties
  • Use automated tools to scrape or extract data from the Service
  • Redistribute or republish briefing content for commercial purposes

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect portfolio data solely to provide the briefing service. We do not sell your personal or financial data to third parties.

8. AI-Generated Content

Briefings are generated by artificial intelligence and may contain inaccuracies, errors, or outdated information. AI outputs should be used as a starting point for your own research, not as sole decision-making criteria. We make no guarantees about the accuracy, completeness, or timeliness of AI-generated content.

9. Limitation of Liability

We are liable without limitation for damages arising from injury to life, body, or health; for intentional or grossly negligent breaches of duty; and for liability under mandatory statutory provisions (including the German Product Liability Act).

For simple (ordinary) negligence, we are only liable if an essential contractual obligation (Kardinalpflicht) has been breached — i.e., an obligation whose fulfillment is necessary for the proper execution of the contract and on whose compliance you may regularly rely. In such cases, liability is limited to the foreseeable, contract-typical damage.

We are not liable for simple negligence in the breach of non-essential contractual obligations. In particular, we are not liable for indirect damages, loss of profits, or investment losses that are not the foreseeable, contract-typical consequence of a breach of duty.

10. Termination

We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the modified terms.

12. Widerrufsbelehrung (Right of Withdrawal)

Right of Withdrawal for Consumers (§§ 355 ff. BGB)

If you are a consumer within the meaning of § 13 BGB (i.e., a natural person acting for purposes outside your trade, business, or profession), you have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day of conclusion of the contract. To exercise your right of withdrawal, you must inform us:

of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or an email). To meet the withdrawal deadline, it is sufficient to send your communication before the withdrawal period has expired.

Consequences of withdrawal: If you withdraw, we will reimburse all payments received from you without undue delay and in any event not later than 14 days from the day we are informed of your decision. Reimbursement is made using the same means of payment as the initial transaction, unless expressly agreed otherwise.

Loss of right of withdrawal: The right of withdrawal expires prematurely if we have begun performance of the digital service with your prior express consent and your acknowledgment that you thereby lose your right of withdrawal once the contract is fully performed (§ 356 para. 4 BGB).
